Building Disputes

Building contracts involve significant amounts of money requiring work to be carried out over an extended period of time and this frequently then raises issues involving disputes over delays in payment for work and/or the standard of workmanship.

Frequently, parties' rights are not only affected by written or verbal agreements but also the provisions of the Subcontract Charges Act, the Domestic Building Contracts Act, the Building Services Authority Act or the Building and Contract Industry Payments Act.

Buying or Selling a Property?

Always consult a Lawyer prior to signing a contract.

Are you aware that there are a number of searches and enquiries you should make prior to settlement of a contract? For example:

  • Is the land liable to flooding?
  • Are there any structures or services under the surface which may interfere with the present or future use of the land?
  • Are there any current or proposed changes to traffic flow or any new main roads nearby?
  • Is there any current or pending development which may affect the neighbourhood?
  • Is the present use consistent with the permitted use of the land?
  • Do improvements have Local Government approval?

The contract may need amending before you sign it to cover these issues.

Discrimination

Both the Federal and State Governments have legislation in force protecting people against discrimination.

People are protected from being discriminated against in relation to any attribute concerning their sex, relationship status, parental status, pregnancy, breast feeding, race, age, religion, political activity or belief, trade union activity, impairment, lawful sexual activity, family responsibilities, sexuality, gender identity or because they are associated with someone with these attributes. Discrimination is extended to any person advocating racial or religious hatred or hostility.

Discrimination happens if a person treats a person with a specified attribute (listed above) less favourably and the attribute is a substantial reason for the treatment.

Employment Law

The Queensland Industrial Relations Act 1999 sets out the minimum standards or obligations of employment. Where the employer is a corporation or the Commonwealth or a waterside, maritime or flight crew entity then the Commonwealth Workplace Relations Amendment (Work Choices) Act 2005 now overrides the Queensland Act. Different industries or different businesses within those industries may have their own Industrial Award or Contract of Employment or Certified or Workplace Agreement, but they usually cannot offer less than the minimum provision set out in the Industrial Relations Act.

Formal agreements can now be put in place under the Commonwealth Workplace Relations Amendment (Work Choices) Act of 2005 as an alternative to an award.

It is recommended that you seek advice from Grant & Simpson Lawyers if you are an employer considered dismissing an employee to ensure that you follow the correct procedure to avoid an action for wrongful dismissal. Alternatively, if you are an employee we can advise you in respect of your rights to avoid dismissal or to enable an action for re-employment or compensation.

Further, if you are considering whether to set up a business as an independent contractor or employer the Australian Tax Office, Workers' Compensation, Workplace Health and Safety and other departments, organisations or insurance companies can argue that a different arrangement applies which could cause significant hardship. You should consider obtaining legal advice on this issue.

Wills & Powers of Attorney

Powers of Attorney

Everyone knows the importance of making a Will to ensure that your assets are distributed to the persons you wish to receive them. It is equally important that you have a Power of Attorney to ensure that, if you become disabled through an accident or illness, you have appointed an attorney who can make decisions on your behalf.

The most commonly used Power of Attorney is an enduring one which continues or "endures" even if you lose the mental capacity to make decisions for yourself.

An Enduring Power of Attorney does not permit your attorney to decide to withdraw or withhold life saving measures. This can only be done under an Advanced Health Directive which expands the powers given under an Enduring Power of Attorney to special health matters.

If you wish to authorise someone to act for you in a particular transaction you can do this by signing a General Power of Attorney.

Whatever type of Power of Attorney you may be considering Grant & Simpson can advise you on which is most appropriate for your circumstances.

Wills

It is important that everyone makes a Will to ensure that their assets are distributed to the persons they wish to benefit. If you do not have a Will when you die your estate will be distributed in accordance with a formula set out in legislation, which may be opposite to what you want.

Similarly, if you make a Will yourself and it does not comply with the law it could be invalid and the situation would then be the same as if you had not made a Will.

This is why it is essential that you obtain proper advice, not only as to how to word your Will to ensure the persons you want to benefit do so, but also as to the taxation and stamp duty consequences of the effects of your Will. We have the qualifications and expertise to provide this advice.
